City Council requested an ordinance to require landlords to provide tenants a list of fees when they apply to live somewhere. This ordinance would apply to landlords who own five or more dwellings. The types of fees include but are not limited to:
- APPLICATION & MOVE-IN FEES (e.g., processing, utility connection, administrative)
- MANDATORY RECURRING FEES (e.g., trash, amenities, pest control, renter insurance)
- OPTIONAL RECURRING FEES (e.g., pet fees, parking)
The rule would not include fees related to lease violations, damages caused by tenants, or similar charges after the lease begins. The Resolution also directs staff to study the feasibility of landlords disclosing fees in the advertising of a rental home.
For the purposes of this survey, fees are distinct from base rent and any utility costs that vary based on usage. Visit the speakupaustin.org/RentalFees main page for information on the topic.
